Montessori Lernwelt – General Terms and Conditions (GTC)

§ 1 Scope and Provider

1.1 These General Terms and Conditions (GTC) apply to all orders placed via the Montessori Lernwelt online shop (hereinafter "provider").

1.2 Deviating terms and conditions of the customer are not recognized unless their validity is expressly agreed to in writing.

1.3 The product range is exclusively aimed at consumers within the meaning of § 13 BGB. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.

§ 2 Conclusion of Contract

2.1 The presentation of the products in the online shop does not constitute a legally binding offer but an invitation to order.

2.2 By clicking the "Buy now" button, the customer makes a binding purchase offer.

2.3 The provider accepts the order either by sending an order confirmation by email or by delivering the goods within 2 business days.

2.4 The customer receives an order confirmation by email immediately after ordering. Processing and shipping usually take place within 1–3 business days after payment is received.

2.5 Cancellations are only possible within 24 hours after the order. After that, the regular processing and shipping process begins, so a cancellation can no longer be considered.

§ 3 Prices and Taxes

3.1 All prices on the website are net prices excluding taxes. The applicable VAT is added and shown during the checkout process.

3.2 The prices valid at the time of the order apply.

§ 4 Shipping Costs and Delivery

4.1 Delivery is made to the countries selectable in the online shop.

4.2 No shipping costs are charged for all deliveries.

4.3 If not all ordered products are available, the provider is entitled to partial deliveries, provided this is reasonable for the customer.

4.4 The delivery time is usually 7–15 working days, depending on the destination country.

§ 5 Payment Terms

5.1 The following payment methods are available in the online shop:

  • Credit Card (Visa, Mastercard, American Express)
  • PayPal
  • Shop Pay
  • Google Pay
  • Apple Pay

5.2 Payment is due immediately upon conclusion of the contract.

§ 6 Right of Withdrawal

6.1 Consumers have a statutory right of withdrawal of 14 days.

6.2 Details are regulated in the cancellation policy, which is available on a separate page.

6.3 A return is only possible after receipt of the goods and must be made in accordance with the cancellation policy.

6.4 The customer is obliged to ensure before placing the order that all information (delivery address, product variants, etc.) is correct to avoid unnecessary returns and delays.

§ 7 Retention of Title

The goods remain the property of the provider until full payment has been made.

§ 8 Warranty

The statutory warranty rights apply.

§ 9 Liability

9.1 The provider is fully liable in cases of intent and gross negligence.

9.2 In cases of simple negligence, the provider is only liable for damages resulting from the breach of essential contractual obligations (cardinal obligations), limited to foreseeable damages.

9.3 Liability for damages resulting from injury to life, body, or health remains unaffected.

§ 10 Online Dispute Resolution

The EU Commission provides a platform for online dispute resolution (ODR):

The provider is neither obligated nor willing to participate in dispute resolution procedures before a consumer arbitration board.

§ 11 Final Provisions

11.1 The law of the Federal Republic of Germany applies, excluding the UN Sales Convention.

11.2 Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
