Montessori Lernwelt – General Terms and Conditions (GTC)

§ 1 Scope and Provider

1.1 These General Terms and Conditions (GTC) apply to all orders placed through the online shop of Montessori Lernwelt (hereinafter referred to as the “Provider”).

1.2 The customer’s deviating terms and conditions are not accepted unless their validity is expressly agreed to in writing.

1.3 The range of goods is intended exclusively for consumers within the meaning of Section 13 of the German Civil Code (BGB). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor attributable to their independent professional activity.


§ 2 Conclusion of the Contract

2.1 The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.

2.2 By clicking the “Buy now” button, the customer submits a binding offer to purchase.

2.3 The provider accepts the order either by sending an order confirmation by email or by delivering the goods within 2 business days.

2.4 The customer receives an order confirmation by email immediately after placing the order. Processing and shipping generally take place within 1–3 business days after receipt of payment.

2.5 Cancellations are only possible within 24 hours after placing the order. After that, the regular processing and shipping process begins, so a cancellation can no longer be accepted.


§ 3 Prices and Taxes

3.1 All prices on the website are stated as net prices excluding taxes. The applicable VAT will be added and shown during the checkout process.

3.2 The prices applicable at the time of ordering shall apply.


§ 4 Shipping Costs and Delivery

4.1 Delivery is made to the countries that can be selected in the online shop.

4.2 No shipping costs are charged for any deliveries.

4.3 If not all ordered products are available, the provider is entitled to make partial deliveries, insofar as this is reasonable for the customer.

4.4 Delivery generally takes 7–15 business days, depending on the destination country.


§ 5 Payment Terms

5.1 The following payment methods are available in the online shop:

  • Credit card (Visa, Mastercard, American Express)
  • PayPal
  • Shop Pay
  • Google Pay
  • Apple Pay

5.2 Payment is due immediately upon conclusion of the contract.


§ 6 Right of Cancellation

6.1 Consumers have a statutory right of cancellation of 14 days.

6.2 Details are regulated in the cancellation policy, which is available on a separate page.

6.3 A return is possible only after receipt of the goods and must be carried out in accordance with the cancellation policy.

6.4 Before placing the order, the customer is obliged to ensure that all details (delivery address, product variants, etc.) are correct in order to avoid unnecessary returns and delays.


§ 7 Retention of Title

The goods shall remain the property of the provider until payment has been made in full.


§ 8 Warranty

The statutory liability rights for defects shall apply.


§ 9 Liability

9.1 The provider shall be liable without limitation in cases of intent and gross negligence.

9.2 In cases of ordinary negligence, the provider shall be liable only for damages resulting from the breach of essential contractual obligations (cardinal obligations), limited to foreseeable damage.

9.3 Liability for damages arising from injury to life, body, or health shall remain unaffected.


§ 10 Online Dispute Resolution

The EU Commission provides a platform for online dispute resolution (ODR):

The provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.


§ 11 Final Provisions

11.1 The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

11.2 Should individual provisions of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
